Presenting a brief, political history of transitional justice, this chapter shows the ways in which transitional justice is caught between international human rights' normative claims and local norms and constraints regarding delivering justice. The chapter was published in the SAGE Handbook of Human Rights, a two-volume set that analyses human rights issues of both contemporary and future importance.

Jasmina Brankovic is a transitional justice researcher and practitioner. She is a Senior Researcher with the Centre for the Study of Violence and Reconciliation and the Associate Editor of the International Journal of Transitional Justice. With a focus on participatory methods, she conducts research on inequality and socioeconomic transformation, climate justice, gender in conflict, and civil society strategies for social change in transitional contexts.
Dr. Hugo van der Merwe is the Director of Research, Knowledge and Learning at the Centre for the Study of Violence and Reconciliation. Since joining CSVR in 1997, he has developed and managed numerous research projects evaluating the work and impact of the South African Truth and Reconciliation Commission and managed various research, advocacy and intervention projects relating to transitional justice in South Africa and on the African continent.
